Defense counsel for HCF Shawnee, an Ohio managed care facility providing care for disabled and elderly patients, in a case in which a former employee alleged unlawful retaliation under the Family Medical Leave Act, 29 U.S.C § 206 et seq.
The court granted defendant’s motion for summary judgment because the plaintiff failed, as a matter of law, to show (i) that her employer knew that she was exercising her rights under FMLA activity and the adverse employment action; and/or (iii) that her employer’s valid, nondiscriminatory reason for termination was pretext.
