Companies are continuing to face increased litigations from non-practicing entities (NPE's) and the funding for these entities can be substantial.  Some of the factors that companies are having to consider in dealing with well-funded NPE's are the new rocket docket in the Western District of Texas, funded litigation in the fast-paced international trade commission, the Patent Office's restrictions on filing multiple inter partes review petitions, and the ability to bring a motion to dismiss for failing to claim patentable subject matter.  The panel will discuss strategies for effectively combatting NPE's in today's environment.
