Segregating Damages from Multiple Occurrences/Events
Segregating damages and related costs among multiple occurrences can be one of the most significant challenges in resolving claims. The quality of the collection of the data and how it is considered and then presented is often the difference between successful claim resolution and litigation.
The panel will present two case studies arising out of 1. damages to six different hotels in Florida affected by Hurricanes Charlie, Frances, and Jean and 2. Superstorm Sandy (wind vs. flood). Both matters involved significant damages to structures from winds and water and required significant forensic engineering analysis, weather analysis, consideration of codes, and certain policy endorsements in arriving at estimates of damages. Through the eyes of the experts on the panel, the audience will have a front seat pass to learn how the process works as well as the skills and tools needed to investigate these losses. The panel will discuss lessons learned about how adjusters and experts can increase the chances of successful claims resolution and how to best prepare to defend the claims if they cannot be resolved.

This course will discuss the handling of a Business Interruption and Lost Profits Claim involving a Hotel. The panel will discuss both the application of case law and accounting principals to the facts of the case.
