Aakash K. Patel

Aakash K. Patel is a senior associate in Flaster Greenberg’s Intellectual Property (IP) Department and Patent Practice Group.  Aakash focuses his practice on intellectual property litigation in the electrical, artificial intelligence, mechanical, semiconductor, medical device, and computer fields. Relying on his education and work experience as a computer engineer for a Fortune 100 technology and communications company, Aakash also manages patent prosecution and patent portfolios in myriad technologies.  Through his wide range of both legal and engineering experience, Aakash has become well versed in computer networking, artificial intelligence, electronics, cloud computing, data security/cryptography, medical devices, automated control systems, wireless communications (e.g., cellular communications, Wi-Fi, Bluetooth, Thread, ZigBee.) light emitting diode (LED) fabrication and structure, computer software, and telecommunications systems.

Aakash is a skilled litigator with significant experience in the major intellectual property venues, including the Court of Appeals for the Federal Circuit, the International Trade Commission, and the Federal District Courts for the District of Delaware, Eastern and Western Districts of Texas, Southern and Eastern Districts of New York, and the Northern and Central Districts of California.  Aakash’s complex litigation experience spans patent infringement, trade secret, copyright, trademark, business torts, and contractual disputes.  Aakash has also provided counsel on inter partes review proceedings at before the United States Patent and Trademark Office.

Aakash’s approach to litigation is simple: Know the facts, whether good or bad, and develop a winning theme from the start tailored to the client’s goals.  To meet this approach, Aakash works with clients and technical experts to intimately understand the underlying technology.  He also develops thorough understanding of the opposing party’s facts, regularly deposing both fact and expert witnesses. As an example, Aakash recently deposed an inventor and obtained a key non-infringement admission that led to a favorable ruling and affirmance on appeal in favor of his client.  

In addition to litigation, Aakash also counsels clients on transactional matters, including freedom-to-operate and strategic portfolio management. For instance, Aakash is adept at developing, managing, and monetizing patent portfolios that relate to standard essential patents such as Thread, 3GPP, and 802.11, advising clients on freedom-to-operate issues, patentability analyses, and strategic patent drafting.  He also uses this experience to counsel clients on fair and reasonable non-discriminatory (FRAND) issues and licensing negotiations. 

Prior to his legal career, Aakash worked as a computer engineer at one of the largest broadcasting and telecommunications companies in the world where he engineered the spam filtration software for over thirty (30) million customer email inboxes, and designed, architected, and implemented a distributed database of usage and security information that serviced multiple internal business units.

Representative Matters

  • Experience litigating patent, copyright, trade secret, and trademark claims in various venues including in U.S. District Court and at the U.S. International Trade Commission (ITC).  Example technologies include:
    • LEDs and LED packaging;
    • Computer software systems including cloud-based software applications, retail and online systems, smartphone apps and back-end systems;
    • Radio frequency identification and related software systems;
    • Vehicle-embedded artificial intelligence and machine learning;
    •  Virtual and augmented reality;
    • Automotive equipment; and
    • Internet-embedded software.
  • Experience prosecuting and managing portfolios related to:
    • Telecommunications technology, including 4G LTE, 5G NR, and 802.11 (Wi-Fi);
    • Computer software, including artificial intelligence (e.g., software implementing various neural networks and other machine learning technology), data security, graphical user interfaces (GUIs), software-based cloud databases, and other software features; 
    • Computer vision and three-dimensional imaging software; and
    • Industrial control systems and processes.
  • Experience supporting litigation and licensing efforts during prosecution of clients’ patent portfolios.
  • Experience in post-grant validity procedures worldwide, including U.S. inter partes review, U.S. reissue applications, EPO opposition proceedings, and Chinese Invalidation Proceedings.
