Bankruptcy Litigation
While litigation is often a last resort, when it is the appropriate course of action, we are tenacious in our pursuit of meeting your objectives in resolving matters. We handle complex bankruptcy litigation including preference, fraudulent conveyance, and equitable subordination actions, adequate protection motions, relief from automatic stay, claim objections and resolutions, director and officer liability, and other commercial litigation that may arise in the bankruptcy context.
Bankruptcy-Related Transactions and Acquisitions
We assist our clients with transactions associated with bankruptcy, including forbearance agreements and workouts, asset purchases, cash collateral stipulations, subordination agreements, leveraged leases, securitizations, and other structured financings and debtor-in-possession loans.
Creditor Representation
Our attorneys assist with creditor protection and represent all types of secured and unsecured creditors, creditors’ committees, plan administrators, landlords, equipment lessors, suppliers, and various other creditors, both large and small. We help with risk management and review the soundness of restructuring methods and develop strategies to maximize the potential return to our clients.
Debtor Representation
Businesses and individuals facing severe financial problems need sound advice, information about their options, and a plan of action. As a debt relief agency, our attorneys work closely with clients to assess risk management and develop creative strategies for debt restructuring, financial rehabilitation, and the potential for reorganization. We advise concerning the ramifications of pending litigation and collection pressures and explain the consequences of foreclosures and forced asset liquidations. Most importantly, we clearly outline possible options and any alternative risk management strategies. We demonstrate how our clients can emerge from distressed situations, discreetly outlining the best available recourse to move forward, with or without commencement of a bankruptcy proceeding.
Risk Management
Large institutional clients may be most vulnerable to risks that would expose them to bankruptcy. Our attorneys provide institutional clients with risk management strategies that emphasize the development of business practices for risk mitigation.
